Auction Terms & Conditions Terms & Conditions Written sealed bids must be submitted on the REAL ESTATE SEALED BID FORM by mailing or delivering to Graber Auctions, LLC, 1382 South State Road 257, Washington, IN 47501 or [email protected] Bid forms should include bidder's name, address, phone number, email, amount of bid, and signed signature. Sealed Bids must be delivered to Graber Auctions, LLC in person, by Mail, or email no later than 8 am ET March 26, 2021 It is the bidder's sole responsibility to ensure that their REAL ESTATE SEALED BID FORM is received by Graber Auctions. LLC before auction closing. No verbal bids will be accepted. REVIEW SEALED BIDS: All sealed bids will be opened and reviewed by Graber Auctions, LLC and Seller. At the time of acceptable offer, Seller and Buyer will immediately enter into a Purchase Agreement. If no acceptable offers have been made, the top 3 bidders will be notified to submit their best and final offer. Seller reserves the right to accept or reject any bid/offer or to waive any technicalities and defects in a REAL ESTATE BID FORM. BIDDER PARTICIPATION: By submitting a sealed bid to purchase the subject property, Bidder agrees to participate and be bound by the terms and conditions. BIDDER PREMIUM: A 3% Buyer's Premium will be added to the accepted bid to form the contract price. AWARD OF CONTRACT: At the conclusion of the sealed bid process, Graber Auctions, LLC and Seller may award the sale of the property to the accepted bidder. In the event of a tied bid, Graber Auctions, LLC will ask the tied bidders to submit a final and best offer to break the tie bid. At the time of an acceptable offer Seller and Buyer will immediately enter into a Purchase Agreement. The Buyer shall then have three (3) business days after the receipt of the Purchase Agreement with no contingencies with the balance of $5000.00 earnest money, (nonrefundable) paid by check or cash to Graber Auctions, LLC and held in escrow. Closing date of sale will be on or before 30 days after the execution of a signed Purchase Agreement and deposit of the earnest money. THERE ARE NO CONTINGEIES IN THIS TRANSACTION. Sold "AS IS/WHERE IS" WTH ALL FAULTS, IN ANY. NO WARRANTY AS TO CONDITION OR SUITABLITY FOR ANY PURPOSE IS EXPRESSED OR IMPLIED. EVIDENCE OF TITLE: Seller shall provide an owners title insurance policy in the amount of the purchase price. DEED: Seller shall provide Warranty Deed(s). CLOSING: The balance of the purchase price is due at closing, which will take place in 45 days after the auction, or as soon thereafter as applicable closing documents are completed by the Seller. Costs for an administered closing shall be shared 50/50 between Buyer(s) and Seller(s). REAL ESTATE TAXES: Real Estate taxes shall be prorated to the date of closing. PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries and due diligence concerning the property. Seller disclaims any and all responsibility for Bidders safety during any physical inspection of the property. SURVEY: The cost of the survey, if needed, will be the responsibility of the buyer.
